It is no answer to say that when the war is over the citizen may once more resume his rights and feel some security in his liberty and his person. As I have already tried to point out, now is precisely the time when the country needs the counsel of all its citizens. In time of war even more than in time of peace, whether citizens happen to agree with the ruling administration or not, these precious fundamental personal rights-free speech, free press, and right of assemblage so explicitly and emphatically guaranteed by the Constitution should be maintained inviolable.

Our democracy is not in peril-we do not live in a democracy. The image of our democracy is in peril. The deep state-the generals, bankers, corporatists, lobbyists, intelligence chiefs, government bureaucrats and technocrats-is intent on salvaging the brand. It is hard to trumpet yourself as the world's guardian of freedom and liberty with Donald Trump blathering on incoherently about himself, inciting racist violence, insulting our traditional allies along with the courts, the press and Congress, tweeting misspelled inanities and impulsively denouncing or sabotaging bipartisan domestic and foreign policy.

The critical question of "standing" would be simplified and also put neatly in focus if we fashioned a federal rule that allowed environmental issues to be litigated before federal agencies or federal courts in the name of the inanimate object about to be despoiled, defaced, or invaded by roads and bulldozers and where injury is the subject of public outrage. Contemporary public concern for protecting nature's ecological equilibrium should lead to the conferral of standing upon environmental objects to sue for their own preservation. This suit would therefore be more properly labeled as Mineral King v. Morton.

A strong and independent Judiciary is necessary for our republic to remain strong, for our democracy to survive, and for the rule of law to flourish. To understand what I mean by independence, let me first clarify what independence is not. Judicial independence does not mean complete freedom from scrutiny or criticism. Judges' decisions may be criticized, and the nature of the job virtually guarantees it. After all, in every court case there will be a loser. Judges must resist the temptation to craft their opinions to avoid criticism or to seek approval, whether from the press, the public, the academy, or Congress.
