The belief that torture is always wrong is a prejudice inherited from an obsolete philosophy. We need to shed the belief that human rights are violated when a terrorist is tortured. As Rawls and others have shown, basic freedoms must form a coherent whole. Self-evidently, there can be no right to attack basic human rights. Therefore, once the proper legal procedures are in place, torturing terrorists cannot violate their rights. In fact, in a truly liberal society, terrorists have an inalienable right to be tortured.This is what demonstrates the moral superiority of liberal societies over others, past and present. Other societies have degraded terrorists by subjecting them to lawless and unaccountable power. In the new world that is taking shape, terrorists, although they themselves degrade human rights by practising terrorism, will be afforded the full dignity of due legal process, even while being tortured.

The question really arises is it a republic if you can keep it, question have we kept it? And the answer is no! No we have not kept it. Since 2001 we have in effect an elected monarchy. And ah, meaning a country which Nixon's view 'when a president does it, it is legal'. The president says it's not illegal. That is the attitude long after Nixon of John Yoo, who was the advisor to George W. Bush, of David Addington, Bush Cheney's legal advisor. Essentially there are no limits on presidential power except those which he chooses to put on himself. Obama following on, has in effect decriminalized torture which is as illegal and criminal as anything can be under international law and domestic law, a number of domestic laws and international laws, which we have ratified to investigate, and follow-up if there is any credible charge. Obama has chosen not to investigate or indict any higher up for that process of torture.

Since the word "knowledge" occurs in my general title... I am going to be talking about epistemology, although I prefer to use the eighteenth-century, indeed, medieval phrase, "natural philosophy."... that enterprise of the human mind which attempts to trace lawfulness to nature, dead and living, but which is not directed to specific inquiries into how this or that law works. Philosophy in the sense in which I practice it, natural philosophy, is concerned with lawfulness rather than with laws and the general nature of laws rather than with the specific structure of this or that law. Natural philosophy was one of the three topics (moral philosophy and metaphysical philosophy were the others) to which one graduated in medieval universities after having studied the seven liberal arts.
I believe that we need to review the whole of our natural philosophy in the light of scientific knowledge that has arisen in the last fifty years.

The typical reaction of liberal intellectuals is to seize on the contradiction here: How can something be both wrong and right, or at least both wrong and OK, at the same time? What liberal intellectuals fail to see is that this so-called contradiction expresses the quintessence of the Machiavellian and therefore the modern, a quintessence that has been thoroughly absorbed by the man in the street. The world is ruled by necessity, says the man in the street, not by some abstract moral code. We have to do what we have to do.
If you wish to counter the man in the street, it cannot be by appeal to moral principles, much less by demanding that people should run their lives in such a way that there are no contradictions between what they say and what they do. Ordinary life is full of contradictions; ordinary people are used to accommodating them. Rather, you must attack the metaphysical, supra-empirical status of necessità and show that to be fraudulent.

Here is my proposal. Israel should announce an immediate unilateral cessation in retaliation against terrorist attacks. This moratorium would be in effect for a short period, say four or five days, to give the Palestinian leadership an opportunity to respond to the new policy. It would also make it clear to the world that Israel is taking an important step in ending what has become a cycle of violence. Following the end of the moratorium, Israel would institute the following new policy if Palestinian terrorism were to resume. It will announce precisely what it will do in response to the next act of terrorism. For example, it could announce the first act of terrorism following the moratorium will result in the destruction of a small village which has been used as a base for terrorist operations. The residents would be given 24 hours to leave, and then troops will come in and bulldoze all of the buildings.
