A presumption of equality may be contrary to present fact, and yet not contrary to a desideratum. We are not as a fact all equally fit to live, equally responsible, or equally deserving of the protection of the law: but it will hardly be doubted that it would be desirable if we were. But further, the presumption of a desired condition is, in any group of plastic minds, a force tending to bring about the thing presumed, i. e., to create it. It aids a boy to reach maturity to treat him as if he were a little older than he is. A little older: for the presumption loses its effect if it is too wide of the actual fact. The fundamental presumptions of the law are justified on this basis and to this extent: if they are too wide of the truth to be creative, they are not justified.

From the point of view of the development of Marx' s theories, his early journalistic writings are important for two main reasons. In his sharp attacks on the censorship law he spoke out unequivocally for the freedom of the Press, against the levelling effect of government restriction (‘ You don' t expect a rose to smell like a violet; why then should the human spirit, the richest thing we have, exist only in a single form?'), and also expressed views concerning the whole nature of the state and the essence of freedom. Pointing out that the vagueness and ambiguity of the Press law placed arbitrary power in the hands of officials, Marx went on to argue that censorship was contrary not only to the purposes of the Press, but to tbe nature of the state as such.

It has often been matter of regret in modern times that, in the construction of the Statute of Limitations, the decisions had not proceeded upon principles better adapted to carry into effect the real objects of the Statute; that instead of being viewed in an unfavourable light as an unjust and discreditable defence, it had not received such support as would have made it what it was intended to be, emphatically a Statute of repose. It is a wise and beneficial law, not designed merely to raise a presumption of payment of a just debt from lapse of time, but to afford security against stale demands after the true state of the transaction may be forgotten, or be incapable of explanation by reason of the death or removal of witnesses.
